Gift Card Terms and Conditions
Effective as of June 25th, 2024
ICE Gift Card Agreement. The following terms and conditions govern the issuance and use of your Gift Cards (the "Card") issued by The Institute of Culinary Education, Inc., a New York corporation (“ICE”). Please read this agreement (this “Agreement”) carefully and keep it for your records. For purposes of this Agreement, the words “you” and “your” mean (a) the person to whom we issue a Card; (b) the person who has purchased the Card; and (c) the person using the Card. “We”, “us”, and “our” means ICE, its successors, agents, affiliates or assigns. By purchasing, signing or using the Card or permitting anyone else to use the Card, you agree to the provisions of this Agreement. The Card is a prepaid card access device that can be used to purchase classes in the Recreational division and other products offered by ICE from time to time. The value associated with your Card is not insured by the Federal Deposit Insurance Corporation (FDIC). The unused balance on your Card does not earn interest.
ICE Gift Cards may not be used to purchase an additional gift card.
ICE Gift Cards are valid (a) anywhere for virtual classes; and (b) at our NYC location only, for in-person classes.
Fees and Charges:. All Cards purchased/issued prior to December 10, 2022, will, after a 36-month period of inactivity, be subject to a $10 monthly fee which will be deducted from the Card’s value until the Card balance is exhausted.
Expiration.. All Cards purchased/issued on or after June 25th, 2024 will expire nine (9) years after the Card is issued or after funds are last loaded onto the Card (whichever is later).
Card Acceptance and Registration. Please sign your Card immediately.
Balance Inquiry. You can check the balance of your Card at any time by calling (888) 481-0757.
Telephone Number and Address To Be Notified in Event Of A Lost Or Stolen Card Or Unauthorized Transfer. You should notify us IMMEDIATELY if your Card has been lost or stolen. If you believe your Card has been lost or stolen, or that someone without your authorization has utilized or transferred or may attempt to utilize or transfer your Card, please call us immediately at (212) 847-0700 or write to us at ICE Gift Card Services, The Institute of Culinary Education, Brookfield Place at 225 Liberty Street, New York, NY 10281. Telephoning is the best way of keeping your possible losses down. To receive a replacement Card, you will have to provide us with the information that confirms that you are the owner of the Card.
Card Usage and Limitations. Subject to the limitations described in this Agreement, your Card can be used anywhere where ICE Recreational classes or other products are offered and sold. Upon any purchase via online, mail order, telephone order, or other purchase transaction, the amount available on the Card is reduced by the amount of such purchase. The amount of value shown on our records is determinative of the value. The Card does not have a PIN and cannot be used to obtain cash at an ATM or branch location (except as provided in the next sentence), or to make preauthorized regular payments. If a Card has a remaining balance of less than five dollars, the Card may be redeemed upon request for its remaining balance. You are responsible for all transactions initiated by use of your Card. If someone else uses your Card, we will treat this as if you have authorized this person to use your Card and you will be responsible for any transactions initiated by such person with your Card. The amount available on your Card will be reduced by the amount of any purchase or transaction. We may charge the Card for all transactions you initiated or authorized, even though a negative balance may be created, but we have no obligation to permit a negative balance on the Card. If you use the Card for a transaction greater than the remaining balance, we will then require payment for the excess by cash, credit/debit card or another gift card. You agree that you will not use your Card for any illegal purpose. The use of your Card to purchase our classes and other products constitutes a simultaneous withdrawal of the funds available on the Card, even though transactions may not actually be posted until a later date. You do not have the right to stop payment on any transaction originated by use of your Card.
Error Resolution Procedures. Call us immediately at (212) 847-0700 or write to us at ICE Gift Card Services, The Institute of Culinary Education, Brookfield Place at 225 Liberty Street, New York, NY 10281 if you think your receipt is wrong or if you need more information about a transaction listed on the receipt. If you tell us orally, we may require that you send your complaint or question in writing within 10 business days. We must hear from you no later than 60 days after the date of the transaction in question and you must provide the following information: (a) Your name, Card number; (b) A description of the error or the transaction you are unsure about and an explanation of why you believe it is an error or why you need more information; and (c) The dollar amount of the suspected error. We will endeavor to notify you of the results of our investigation within 10 business days after we hear from you, and we will correct any error promptly. In some instances, it may take up to 45 calendar days to investigate your complaint or question. If an error involves a transaction that was either initiated other than in any state, territory or possession of the United States, the District of Columbia, the Commonwealth of Puerto Rico or any political subdivision of any of the above; or involves a transaction resulting from a point-of-sale debit transaction, the applicable time period for investigation shall be 90 calendar days. We will notify you of the results after completing our investigation.
Liability For A Lost Or Stolen Card Or Unauthorized Use. You will not be liable for any losses if you immediately notify us of the loss, theft or unauthorized use of your Card and if you: (a) Signed your Card; (b) Exercised reasonable care in safeguarding your Card from risk of loss or theft; (c) Inform us of the number of your Card and the approximate date of its last authorized use; (d) Report all facts of the loss or theft to us and cooperate in our investigation.
Failure to Make Transfers. If we fail to complete a transaction arising from use of your Card in a timely manner and in the correct amount according to our agreement with you, we will be liable for your losses or damages that result solely and directly from such failure. However, we will not be liable for any of the following: (a) If through no fault of ours your Card does not have sufficient value remaining on the Card to complete the transaction; (b) If our website, terminal or system was not working properly and you knew about the breakdown when you started the transaction; (c) If circumstances beyond our control (such as fire or flood) prevent the transaction, despite reasonable precautions we have taken; or (d) In the case of any error or malfunction which was not intentional on our part. Under no circumstances will ICE be liable to you for special, punitive, or consequential damages or for any incidental expenses incurred by you, including, without limitation, attorneys' fees.
Disclosure of Account Information to Third Parties. We may disclose information to third parties about your account or the transactions made: (a) Where it is necessary for completing transactions; (b) To verify the existence and condition of your account for a third party, such as a merchant; (c) To comply with government agency or court orders; (d) If you grant your permission; or (e) To resolve an error or an inquiry as to an alleged error.
Revocation. The Card is our property, and we may revoke the Card at any time without cause or notice. However, you are solely responsible for the possession, use and control of the Card. You must surrender a revoked Card and you may not use an expired or revoked Card. When you surrender the Card, you must provide us with a name and address. Upon revocation by us, we will return any remaining value to you directly by check to the address furnished to us.
Scam Alert. Please be cautious of scams requesting payment via gift cards. Cards are intended for gifts, not for payments. Please report suspected scams to the NYC Division of Consumer Protection at (800) 697-1220.
Amendment. To the extent permitted by applicable law, we may change the terms of this Agreement without notice, unless required by law. Changed terms will be posted on our website and will apply to the outstanding balance on your Card as well as to any transactions after the date of the change. In any event, your use of the Card after the date of the change will confirm your agreement to the change.
Governing Law. This Agreement is governed by applicable federal laws and regulation and, to the extent not preempted by federal laws and regulations, by the laws of the State of New York.
